Terms of Use for Academie Seconde Chance USA (A2C)

These Terms of Use (“Terms”) govern your use of the A2C website (the “Site”) and your participation in our soccer ID camps (the “ID Camps”). By accessing the Site or participating in any of our Camps, you agree to comply with these Terms. Please
read them carefully before using our services.
If you do not agree with any part of these Terms, you must discontinue your use of the Site and refrain from registering for any of our Camps.

1. Acceptance of Terms

By accessing the Site, using its services, or participating in any ID Camps, you signify that you accept and agree to be bound by these Terms. This acceptance applies whether you are browsing the Site, submitting a registration form, or participating in any activities associated with our Camps.

1.1. Amendments to Terms

We reserve the right to amend these Terms at any time without prior notice. Any modifications will be effective immediately upon posting on our Site. It is your responsibility to periodically review these Terms for any updates. Continued use of the Site or participation in the ID Camps after any changes constitute your acceptance of the revised Terms.

1.2. Eligibility Requirements

Access to our ID Camps is limited to individuals who meet our specific eligibility requirements, which may include age restrictions, health conditions, or soccer experience levels. If you are under the age of 18, you may only participate in the ID Camps with the consent and supervision of a parent or legal guardian.

2. Eligibility for Participation

2.1. Age and Skill Requirements

All participants must meet the specific eligibility criteria for each ID Camp. ID Camps may have age groupings or skill-level requirements, which will be clearly outlined in the Camp details. By registering, you confirm that you meet the eligibility criteria forthe specific ID Camp. If you are under the age of 18, a parent or legal guardian must provide their consent for your participation and agree to these Terms on your behalf.

2.2. Health and Physical Fitness

It is the responsibility of each participant to ensure they are in good physical health and free of any medical conditions that could impair their ability to participate in the physically demanding nature of soccer camps. A2C may require participants to submit a medical release form or provide documentation confirming fitness to participate.

2.3. Insurance and Medical Care

It is recommended that participants carry their own health insurance. A2C is not responsible for medical expenses incurred during the ID Camp. In the event of an emergency, the ID Camp may seek appropriate medical care, and the participant (orguardian) will be responsible for related costs.

2.4. Special Needs and Accommodations

Participants with special needs or requiring accommodations should notify ID during registration. Reasonable efforts will be made to accommodate requests, subject to availability.

2.5. Right to Refuse Participation

A2C reserves the right to refuse or revoke participation if eligibility criteria are not met, medical conditions are undisclosed, or if behavior is deemed disruptive or unsafe. No refunds will be provided in such cases.

3. Registration and Payment

3.1. Registration Process

To participate in any of our ID Camps, you must complete the registration process, which includes submitting accurate and truthful information, agreeing to these Terms, and making the necessary payment. A2C reserves the right to reject any registration if the provided information is incomplete or inaccurate.

3.2. Payment Terms

All ID Camp fees must be paid in full at the time of registration unless otherwise specified. We accept payment via credit card, bank transfer, or other approved methods listed on the Site. Your spot in the ID Camp is not confirmed until full payment has been received and processed.

3.3. Failure to Pay

Failure to make timely payments will result in the cancellation of your registration. Nice Soccer Camp will not hold spaces for participants who have not completed payment, and once registration is canceled, your spot may be offered to other participants.

4. Health and Safety

4.1. Physical Fitness

Each participant must confirm that they are physically fit and able to participate in the physical demands of soccer activities. Participants must notify us of any medical conditions, allergies, or physical limitations that may affect their ability to fully engage in camp activities. A2C is not liable for injuries sustained by participants who fail to disclose medical conditions.

4.2. Emergency Contact Information

All participants must provide accurate emergency contact information during the registration process. If a medical emergency arises, we will make reasonable efforts to contact the listed emergency contact. However, participants (or their guardians) assume all risks related to medical conditions or emergencies arising from their participation.

4.3. First Aid and Medical Treatment

While we provide basic first aid during the ID Camps, A2C staff are not medical professionals. In the event of a medical emergency, professional medical assistance will be sought, and participants or their guardians will be responsible for any associated costs.

5. Code of Conduct

5.1. Respect and Sportsmanship

Participants are expected to exhibit respect, good sportsmanship, and positive attitudes at all times. This includes respect towards coaches, other participants, and all A2C staff. Any form of disrespect, bullying, or harassment will not be tolerated and may result in immediate dismissal from the ID Camp.

5.2. Disruptive Behavior

Disruptive or harmful behavior, including physical violence, verbal abuse, or intentional damage to property, will result in the removal of the participant from the ID Camp. Parents or guardians will be contacted immediately, and participants may be dismissed without refund.

5.3. Consequences for Violation

Participants who fail to adhere to the Code of Conduct or engage in behavior that disrupts the learning environment may be subject to disciplinary action, including warnings, suspensions, or removal from the ID Camp. No refunds will be provided to participants who are removed due to violations of these Terms.

6. Use of Media: Photography and Videography

6.1. Consent for Media Use

By participating in our ID Camps, you agree that A2C has the right to capture and use your image, voice, and likeness in photos, videos, or other media formats for promotional, educational, and marketing purposes. You hereby grant us a non-exclusive, royalty-free, perpetual license to use these materials in any and all media formats without any compensation to you.

6.2. Usage Scope

Media collected during the ID Camp may be used in a wide range of formats, including but not limited to social media posts, website content, brochures, and advertisements. If you do not consent to your image or likeness being used, you must notify A2C in writing before the start of the ID Camp.

6.3. Waiver of Rights

You acknowledge that you have no right to inspect or approve the final product or media in which your image may appear, and you agree to waive any claims related to the use of your image, voice, or likeness in promotional materials.

6.4. Third-Party Usage

You acknowledge that A2C may share or license the captured media to third parties for promotional or educational purposes. This may include partnerships with sponsors, educational institutions, or other organizations involved in promoting soccer activities. By consenting to this use, you agree that third parties may also utilize your image, voice, or likeness in accordance with the terms outlined herein, and you waive any rights to compensation from such third parties.

7. Intellectual Property Rights

7.1. Ownership of Site Content

All content on the A2C website, including text, graphics, logos, images, videos, and other materials, is the exclusive property of A2C or its licensors and is protected under copyright, trademark, and other intellectual property laws. Unauthorized use of any materials found on the Site is strictly prohibited.

7.2. Limited License

You are granted a limited, revocable, non-exclusive license to access and use the Site and its content for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or create derivative works from the content without prior written consent from A2C.

7.3. Trademark Use

The trademarks, logos, and service marks displayed on the Site are the registered and unregistered trademarks of A2C or its licensors. Unauthorized use of these trademarks is prohibited and may result in legal action.

8. Limitation of Liability

8.1. Assumption of Risk

By participating in our ID Camps, you acknowledge that soccer and related activities involve inherent risks, including the risk of injury. You agree to voluntarily assume all risks associated with participation, including but not limited to falls, contact with other participants, and equipment-related injuries.

8.2. Release of Liability

To the fullest extent permitted by law, you agree to release and hold harmless A2C, its directors, coaches, employees, and agents from any liability for injuries, damages, or losses incurred during your participation in the ID Camps. This includes but is not limited to personal injury, property damage, and financial loss.

8.3. Indemnification

You agree to indemnify and defend A2C from any claims, liabilities, or damages arising from your violation of these Terms, your use of the Site, or your participation in the ID Camps. This obligation applies even if the claim arises from the negligence of A2C.

9. Force Majeure

9.1. Unforeseen Events

A2C shall not be held responsible for any failure or delay in performing its obligations under these Terms due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, pandemics, or any other event constituting a force majeure.

9.2. Rescheduling

In the event that an ID Camp must be canceled or rescheduled due to a force majeure event, we will make reasonable efforts to notify participants and provide alternative options, including rescheduling or issuing a credit for future ID Camps. However, we are not liable for any losses or damages resulting from such cancellations.

10. Cancellation and Refund Policy

10.1. Participant-Initiated Cancellations

If you wish to cancel your participation in an ID Camp, you must follow the cancellation procedure outlined on the A2C website. Refunds will only be issued in accordance with the Cancellation and Refund Policy, which is available on our Site. Cancellations made outside the specified timelines may not be eligible for refunds.

10.2. Camp-Initiated Cancellations

A2C reserves the right to cancel or modify ID Camps for any reason, including but not limited to low enrollment, inclement weather, or unforeseen circumstances. In the event of a ID Camp cancellation, participants will be offered a full refund or the option to transfer to a different ID Camp.

11. Equipment and Attire

11.1. Participant Responsibility

Participants are responsible for bringing their own soccer equipment, including but not limited to cleats, shin guards, soccer balls, and water bottles. 2AC is not responsible for lost, stolen, or damaged personal items.

11.2. Appropriate Attire

Participants must wear appropriate athletic attire and footwear suitable for soccer activities. Participants who fail to wear the necessary equipment or attire may not be permitted to participate in certain activities for safety reasons.

12. Governing Law and Dispute Resolution

12.1. Applicable Law

These Terms shall be governed by and construed in accordance with the laws of Florida , without regard to its conflict of law principles.

12.2. Dispute Resolution

In the event of any disputes arising from these Terms or your participation in the Camps, you agree to first attempt to resolve the issue through good-faith negotiation with A2C.

13. Modifications to Terms

13.1. Right to Modify

A2C reserves the right to modify these Terms at any time to reflect changes in our policies or applicable laws. Any modifications will take effect immediately upon posting the revised Terms on our website (the “Site”).

13.2. Responsibility to Review Terms

Participants are responsible for periodically reviewing these Terms to stay informed of any updates. Continued use of the Site and participation in the ID Camps after modifications constitute acceptance of the revised Terms.

13.3. Notification of Changes

While we may attempt to notify participants of significant changes through email or notices on the Site, it remains your responsibility to check for updates regularly.

13.4. Effective Date

The effective date of the most recent modifications will be displayed at the top of the posted Terms. If you disagree with any changes, you may withdraw from participation in the ID Camps and discontinue your use of the Site.

13.5. Acknowledgment of Terms

By engaging with A2C, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any future modifications.

14. Severability

14.1. Invalidity of Provisions

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable. This modification will ensure that the intent of the original provision is upheld to the greatest extent possible.

14.2. Remaining Provisions

The invalidity or unenforceability of any specific provision shall not affect the validity or enforceability of any other provision contained in these Terms. All remaining provisions will continue to be in full force and effect, and the parties agree that these Terms shall be construed as if the invalid or unenforceable provision had never been contained herein.

14.3. Agreement to Enforce

Both parties agree to work together in good faith to replace any invalid or unenforceable provision with a valid and enforceable provision that closely reflects the original intent of the parties. This collaborative approach aims to maintain the spirit of the Terms while ensuring compliance with applicable laws.
